Why do you need this information?
The States of Jersey (Jersey’s Parliament) passed legislation requiring all Representative Persons for vessels to hold information on Vessels and their owners. Whilst we strongly opposed these changes, the amendment was passed, and we are now legally bound to hold the information.
Is my information safe?
We have taken a decision to NOT hold the information on web-based servers. We will not disclose our exact data storage solutions for security reasons. We have opted to use develop a semi-automated data collection using Adobe Sign and Microsoft to minimise third party exposure to the data. We do not use third party companies to process the information except for automated systems provided by Adobe Sign and Microsoft.
Who is the Data Controller under GDPR?
As the law requires us to hold this information, the Jersey Government may claim that Representative Persons are data controllers. We as a company believe that we are holding this information for the Government and therefore under international law, the Jersey Government would be the data controller.
Do you comply with Data Protection Laws?
Jersey falls under the jurisdiction of the European Court of Human Rights and therefore European Data Protection Laws apply. These are controlled by domestic legislation through Jersey’s Data Protection Laws.
Why have we been given such little notice?
We were effectively given 6 months to analyse the legislation, develop highly complex bespoke data storage systems and create GDPR compliant data collection systems. We could not contact clients until we had the systems in place to safely collect and store their information. Despite working 7 days a week, day and night, our systems are not as refined as we would have liked. We have made every effort to secure people’s information. The forms are designed to be simple to use and we have provided help pages for all forms. Nevertheless, the complexity of the data we are required to hold has necessitated highly complex systems. We have now run out of time and have had to roll out the system in its current form, although development will continue, and we are confident that our new systems will be of great benefit to our clients in future.
What happens if I don’t want to provide this information?
We are obliged to hold this information by law and are susceptible to fines of £10,000 if the information we hold is not correct. If you do not wish to provide this information we will have to terminate our Representative Person services for this vessel. We could possibly assist with moving the vessel to another registry.
